Retrenchment Malaysia 2026: Employer Process, Form PK and Termination Benefits

Retrenchment in Malaysia requires more than a termination letter and a compensation figure. Employers need a genuine business reason, a defensible selection process, the correct notifications and an employee-by-employee payment assessment.

For an eligible employee, statutory termination benefits generally start after 12 months of continuous service and use the applicable 10, 15 or 20 days’ wages per year of service. These benefits are separate from notice pay and other final entitlements.

This guide focuses on private-sector employment in Peninsular Malaysia and Labuan. Sabah and Sarawak have separate labour ordinances. Special employee categories also need separate checks.

Establish what work has become redundant

Retrenchment concerns a genuine reduction in the need for work. Begin with the operating decision: which activity is closing, shrinking or changing, and how many roles will remain?

Prepare a short decision file containing the business evidence, organisation charts before and after the change, affected job functions and alternatives considered. Useful evidence might include an ended customer contract, production-volume changes or a documented process redesign.

Avoid beginning with a list of people management wants to remove and constructing a restructuring explanation afterwards. Where the real concern is performance or misconduct, obtain advice on the appropriate process.

As a practical planning step, assess redeployment, retraining, natural attrition, a hiring freeze and reduced discretionary spending. Record why workable alternatives were accepted or rejected. Follow relevant consultation commitments and collective agreements. JTKSM’s retrenchment guidance points employers towards alternatives and proper procedures.

Review employee selection before approving names

Define the affected employee category before comparing individuals. An organisation-wide ranking can conceal differences between jobs that are not interchangeable.

JTKSM’s management guidelines recognise last in, first out (LIFO). Any departure needs objective, recorded justification and review of applicable agreements. Keep the criteria, supporting evidence and approval trail together; a score sheet created after a complaint will be harder to explain.

Separately, Section 60N requires foreign employees in a similar capacity to be retrenched before local employees. For this Part, permanent residents are excluded from “foreign employee”. Check actual duties and status. See the Employment Act 1955.

Hypothetical manufacturing example: A plant closes one packing line but retains another requiring a specific machine certification. HR should document the remaining work, who can perform it, training feasibility and the selection rationale before issuing letters. Certification should be supported by records and applied consistently.

Plan employee notice and Form PK separately

There are two different timelines: notice to the employee and reporting to the Labour Department.

Employee notice

For redundancy situations covered by Section 12(3), minimum notice is:

ServiceMinimum notice
Below 2 years4 weeks
2 years to below 5 years6 weeks
5 years or more8 weeks

Honour longer applicable terms. Notice must be written; Section 13 provides for payment in lieu. Verify each employee’s period and wage amount against the Act.

Form PK reporting

JTKSM’s current reporting instructions specify:

Filing stageDeadline
Parts I–IV and Appendix 1At least 30 days before the action
Part V and Appendix 1Within 14 days afterwards
Part VIWithin 30 days afterwards

Parts V and VI apply to retrenchments and separation schemes. The reporting framework also covers temporary lay-offs and pay cuts, with the relevant filing requirements.

Download the official Form PK and employee appendix, confirm submission arrangements with the relevant Labour Office and retain evidence of delivery. Payment instead of employee notice does not remove this reporting obligation.

Form PK is also separate from JTKSM workplace registration under Section 63A. Do not apply the registration article’s 90-day timeline to a retrenchment.

Check termination-benefit eligibility before calculating

General Employment Act coverage does not mean everyone qualifies for the same statutory benefits.

The First Schedule excludes Section 60J for employees earning above RM4,000 monthly, subject to specified occupational categories covered regardless of wages, including qualifying manual workers. Check its wage definition, actual duties and special-category exclusions.

The 1980 Regulations generally require at least 12 months’ continuous service, subject to their conditions and exclusions. Renewal, re-engagement and business-transfer situations need particular care.

Outside statutory benefit coverage, review the employment contract, collective agreement and any binding company commitments. Other employment protections can still apply.

Calculate benefits using the correct wage basis

For eligible employees, the statutory minimum is:

Continuous serviceDays’ wages for each year of service
At least 12 months but below 2 years10
2 years but below 5 years15
5 years or more20

Apply the rate for total service to the service period; these are not progressive tax-style bands. Incomplete years are prorated to the nearest month.

Regulation 6 uses average true daily wages over the preceding 12 completed months, with wages defined by the Act. Do not automatically substitute monthly salary divided by 26.

Hypothetical calculation

Assume an eligible employee has:

  • Exactly 3 years and 6 months of service.
  • RM36,000 of qualifying wages over the preceding 12 completed months.
  • No better contractual benefit.

Assuming the 365-day illustration is appropriate:

RM36,000 ÷ 365 × 15 × 3.5 = RM5,178.08

This follows the annual-wages approach illustrated in JTKSM’s retrenchment FAQ. Reconcile variable pay and the relevant period before using the formula in a real case.

Provide written calculation particulars. Statutory termination benefits must be paid within seven days after termination; that deadline does not extend deadlines for other final payments. Honour more favourable applicable entitlements.

Build an itemised final-payment schedule

Give payroll a separate line for each item rather than an unexplained “retrenchment package” total.

Item to reviewPayroll control
Salary up to terminationReconcile attendance, wage period and lawful deductions
Notice or payment in lieuShow the period served and any balance payable
Termination benefitsRecord coverage, wage basis, service and applicable rate
Unused leave and contractual paymentsCheck entitlement, balance and relevant terms
Contributions and tax administrationAssess each component and applicable reporting or withholding

Assign a due date, reviewer and payment record to each line.

Seek advice where employment-payment deadlines interact with tax-clearance requirements. Kanry’s CP22A and tax-clearance guide covers that separate assessment.

Prepare an individual letter explaining the business reason, effective date, notice arrangements, payment breakdown, handover and contact person. Meet affected employees privately and allow time for questions. Keep acknowledgements and payment evidence with the decision file.

Complete the exercise after the last working day

Nominate an owner for Form PK follow-up submissions, outstanding payroll items and applicable foreign-worker administration. Handle employee records and access changes securely.

Give affected employees clear information on where to obtain employment-support guidance without promising benefit approval.

Review subsequent recruitment against the original redundancy rationale. If similar work returns, document what changed before approving a new vacancy.

Frequently asked questions about retrenchment in Malaysia

Does every retrenched employee qualify for statutory termination benefits?

No. Check the First Schedule, Section 60J and the 1980 Regulations, including the minimum service requirement and relevant exclusions. Employees outside statutory benefit coverage may still have contractual or collective-agreement entitlements. Other employment protections can continue to apply.

Does payment instead of employee notice remove the Form PK requirement?

No. Employee notice or its lawful payment substitute and Labour Department notification are separate matters. Plan both timelines. If the proposed date leaves insufficient reporting time, contact the relevant Labour Office before proceeding.

Must every retrenchment follow LIFO without exception?

LIFO is a recognised selection principle, not an automatic answer for every workforce. Define the relevant category, review applicable agreements and document objective reasons for any departure. Separately comply with Section 60N where local and foreign employees work in similar capacities.

Can an employer stop paying monthly salaries during a temporary shutdown?

Do not assume so. JTKSM distinguishes monthly salaried employees from workers whose remuneration depends on work being provided, and states that monthly salaried employees remain entitled to full wages during a shutdown. Obtain advice before imposing unpaid leave or a pay reduction.

Can a retrenchment still be challenged after benefits are paid?

Yes. Payment does not itself establish a genuine redundancy or fair selection. JPPM states that a workman alleging dismissal without just cause or excuse may make a Section 20 representation within 60 days of dismissal, including during the notice period. Keep the decision evidence and payment records.

Coordinate workforce changes with a clear plan

Restructuring decisions affect remaining teams as well as departing employees. Align the revised organisation chart, essential skills, handovers and payroll responsibilities before implementation.

Contact Kanry Search to discuss workforce planning and HR or payroll administration support during organisational change. Obtain specialist employment-law advice for the retrenchment decision, disputed selection or settlement terms.
